These Terms & Conditions govern the use of The Lift Man, LLC website and the purchase of products and services from The Lift Man, LLC. By using our website, submitting an order, accepting a quote, or purchasing products or services from The Lift Man, you agree to these Terms & Conditions.
Products & Services
The Lift Man provides mobility and accessibility products and services, including but not limited to:
Stairlifts
Vehicle lifts
Mobility scooters and power mobility products
Ramps and accessibility equipment
Accessories and replacement parts
Installation, repair, maintenance, and service
Product availability, specifications, colors, features, pricing, and manufacturer offerings may change without notice.
We reserve the right to refuse or cancel an order if a product is unavailable, incorrectly priced, or cannot be safely or properly installed for the intended application.
Quotes & Pricing
Quotes are based on the information available at the time of evaluation and are valid for the period stated on the quote.
Pricing may change if site conditions, measurements, equipment requirements, customer requests, manufacturer pricing, or other circumstances differ from those originally provided or observed.
Additional work or equipment not included in the original quote may result in additional charges. Any significant changes will be communicated to the customer before proceeding whenever reasonably possible.
Deposits & Special Orders
A deposit may be required before equipment is ordered or an installation is scheduled.
Custom, special-order, modified, or customer-specific equipment may become non-refundable once the order has been submitted to the manufacturer.
This includes, but is not limited to, curved stairlifts, custom rail systems, special-order vehicle lifts, custom ramps, and equipment configured specifically for a customer’s home, vehicle, or application.
Cancellation and refund eligibility is governed by our Refund & Return Policy.
Installation
The customer is responsible for providing accurate information regarding the installation location, property, vehicle, electrical service, measurements, and other conditions that may affect installation.
Installation dates and estimated completion times are subject to product availability, manufacturer shipping, weather, site readiness, and other circumstances beyond our reasonable control.
The Lift Man may postpone or decline an installation if conditions are determined to be unsafe or unsuitable.
Unless specifically included in the written quote, The Lift Man is not responsible for unrelated electrical, structural, carpentry, drywall, painting, flooring, plumbing, vehicle modification, or other work that may be necessary to complete an installation.
Customer Responsibilities
Customers are responsible for:
Providing safe and reasonable access to the installation or service location
Providing accurate information about the intended user and application
Following all manufacturer operating and safety instructions
Maintaining equipment according to manufacturer recommendations
Not modifying installed equipment without authorization
Informing The Lift Man of known conditions that could affect safe installation or operation
Accessibility and mobility equipment should only be used for its intended purpose and within the manufacturer’s stated weight, size, and operating limitations.
Vehicle Lift Compatibility
Vehicle lift compatibility depends on multiple factors, including the vehicle, mobility device, hitch, weight capacities, dimensions, and manufacturer requirements.
The customer must notify The Lift Man of any change in vehicle or mobility device before attempting to use previously installed equipment with a different configuration.
The Lift Man is not responsible for damage or unsafe conditions resulting from unauthorized modifications, overloading, misuse, or use with a vehicle or mobility device other than the configuration for which the equipment was evaluated or installed.
Service & Repairs
Service-call, diagnostic, travel, and labor charges may apply regardless of whether a repair can be completed during the initial visit.
Additional parts, labor, or return visits may be required.
Service and repair charges are non-refundable once the applicable service has been performed.
Warranties
Products sold by The Lift Man may include warranties provided by their respective manufacturers. Warranty coverage, exclusions, duration, parts coverage, and labor coverage vary by manufacturer and product.
Manufacturer warranty coverage does not necessarily include labor, travel, diagnostic charges, shipping, removal, reinstallation, or other expenses unless specifically stated.
Damage caused by misuse, neglect, accidents, unauthorized modifications, improper operation, environmental conditions, or failure to follow manufacturer instructions may not be covered by warranty.
Returns & Refunds
Returns, cancellations, deposits, and refunds are governed by The Lift Man’s Refund & Return Policy.
Mobility scooters and other eligible power mobility products returned within the applicable return period are subject to a 25% restocking fee.
Custom and special-order equipment may be non-returnable and non-refundable once ordered.
Payment
Payment is due according to the terms provided on the customer’s invoice, order, or written quote.
The Lift Man reserves the right to require deposits or full payment before ordering equipment, scheduling installation, releasing products, or performing certain services.
Customers are responsible for applicable sales taxes and other charges unless a valid exemption applies.
Website Purchases
We make reasonable efforts to ensure website pricing, product descriptions, photographs, and specifications are accurate. However, errors may occasionally occur.
We reserve the right to correct errors, update information, or cancel an order affected by an incorrect price, description, or availability issue.
Product photographs are for general reference and actual products may vary slightly in appearance or configuration.
Website Information
Information provided on our website is intended for general informational purposes and does not replace an on-site evaluation when one is necessary to determine product compatibility or installation requirements.
Measurements, photographs, and information submitted through our website may be used to assist with product selection or preliminary evaluation. The Lift Man reserves the right to require an in-person evaluation before approving or completing an installation.
Limitation of Liability
To the fullest extent permitted by applicable law, The Lift Man, LLC will not be responsible for indirect, incidental, special, or consequential damages resulting from the use, misuse, failure, or inability to use products or services provided by The Lift Man.
Nothing in these Terms & Conditions is intended to exclude or limit liability that cannot legally be excluded or limited under applicable law.
Delays & Circumstances Beyond Our Control
The Lift Man is not responsible for reasonable delays caused by circumstances outside our control, including manufacturer delays, shipping disruptions, product shortages, severe weather, transportation issues, utility interruptions, or other unforeseen circumstances.
We will make reasonable efforts to communicate significant delays and complete the customer’s order or service as soon as reasonably possible.
Intellectual Property
The Lift Man name, logos, website content, photographs, videos, graphics, and other original materials may not be copied, reproduced, distributed, or used for commercial purposes without permission from The Lift Man, LLC, except where otherwise permitted by law.
Privacy
Information submitted through our website is handled in accordance with our Privacy Policy.
Governing Law
These Terms & Conditions are governed by the laws of the State of Indiana, without regard to conflict-of-law principles.
Any dispute arising from these Terms & Conditions or products or services provided by The Lift Man will be subject to applicable Indiana law.
Changes to These Terms
The Lift Man reserves the right to update these Terms & Conditions at any time. Changes will become effective when posted to our website.
